Terms of Service

1. Agreement Formation

These Terms of Service ("Agreement") constitute a binding contract between you and Seekee governing access to and use of the Seekee application and website located at seekeedrive.com ("Platform"). By creating an account or utilizing any Platform features, you acknowledge acceptance of this Agreement in its entirety.

2. Service Description

Seekee delivers two primary functionalities:

  • Cloud Storage: Secure remote file hosting with cross-device synchronization capabilities
  • AI Image Generation: Automated image creation based on user-supplied text descriptions

Feature availability may vary by subscription tier. We reserve discretion to modify, expand, or discontinue specific functionalities.

3. Account Obligations

Account registration requires accurate identification information. You bear sole responsibility for:

  • Safeguarding login credentials from unauthorized access
  • All activities conducted through your account
  • Immediate notification of suspected security breaches
  • Maintaining current contact information

Account sharing or credential transfer is prohibited without express authorization.

4. Content Ownership and License

Ownership of materials you upload remains exclusively yours. By storing content on our Platform, you grant Seekee a non-exclusive, worldwide license to host, cache, transmit, and display such content solely for service provision purposes.

Regarding AI-generated imagery: you receive full usage rights to images created through your prompts, subject to compliance with these Terms. Attribution to Seekee is appreciated but not mandatory.

5. Prohibited Activities

The following activities are expressly forbidden:

  • Storage or distribution of materials violating applicable law
  • Content depicting exploitation of minors in any form
  • Intellectual property infringement or unauthorized reproduction
  • Malicious software distribution or system interference
  • AI prompt manipulation to generate harmful, deceptive, or unlawful imagery
  • Circumvention of access restrictions or security protocols
  • Automated access without prior written consent
  • Platform usage for harassment, threats, or intimidation

6. AI Generation Guidelines

AI image generation operates through automated systems processing textual input. Users acknowledge that:

  • Output quality and accuracy cannot be guaranteed
  • Generation requests may be logged for abuse prevention
  • Content filters may restrict certain prompt categories
  • Excessive usage may trigger temporary rate limitations
  • Generated content should not impersonate real individuals without consent

7. Storage Allocation

Account storage capacity depends on your selected plan. Exceeding allocated limits may result in upload restrictions until additional space is acquired or existing files are removed. We may implement fair usage policies to maintain system performance.

8. Service Continuity

While we strive for continuous availability, the Platform is provided without uptime guarantees. Scheduled maintenance windows, emergency repairs, or circumstances beyond our control may cause temporary interruptions. We accept no liability for data access delays or service disruptions.

9. Warranty Disclaimer

The Platform is furnished "as is" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including merchantability, fitness for particular purpose, and non-infringement. No advice or information obtained through the Platform creates any warranty.

10. Liability Limitations

Under no circumstances shall Seekee be liable for indirect, incidental, consequential, special, or exemplary damages arising from Platform usage. This includes but is not limited to data loss, revenue reduction, or business interruption. Our aggregate liability shall not exceed amounts paid by you during the twelve months preceding any claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Seekee and its personnel from claims, damages, or expenses arising from your content, Platform usage, or violation of this Agreement or third-party rights.

12. Account Termination

Either party may terminate this Agreement at any time. We reserve the right to suspend or permanently close accounts for:

  • Breach of any provision herein
  • Extended periods of inactivity
  • Fraudulent or suspicious behavior
  • Legal or regulatory requirements

Post-termination, content retrieval is available for 30 days unless termination resulted from policy violations.

13. Modifications

This Agreement may be amended at our discretion. Substantive changes will be announced through Platform notifications or email correspondence. Continued usage following modifications indicates acceptance of revised terms.

14. Dispute Resolution

This Agreement shall be interpreted according to applicable laws. Disputes shall be resolved through good-faith negotiation before pursuing formal proceedings. You agree to waive participation in class action litigation related to Platform usage.

15. Severability

Should any provision be deemed unenforceable, remaining provisions continue in full effect. Unenforceable terms shall be modified to the minimum extent necessary to achieve original intent.
